Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Lex (“Lex”, “we”, “us”), a language-learning toolkit operated from Nuremberg, Germany. By creating an account or subscribing to a plan, you agree to these Terms.

1. Service description

Lex is a calm workspace for learning languages by reading, writing, and building your own vocabulary. It supports 34 languages and provides leveled reading texts, AI-assisted essay feedback, AI text generation, spaced-repetition exercises, and curated starter content for selected languages. A subscription grants you a limited, non-exclusive, non-transferable right to use Lex for as long as your subscription is active and in good standing.

2. Free trial

New self-signed-up accounts receive a 3-day free trial with no payment details required. During the trial you may use AI features up to a small cap (3 total AI calls across all features) so you can evaluate the product. The trial ends automatically after 3 days; we do not auto-charge you, and you do not need to cancel anything.

3. Free essay check

Our landing page offers a single free AI-powered essay check that does not require an account. This is provided as a convenience and is subject to rate limits (one check per browser, additional limits per network and a global daily cap). We may change or discontinue the free check at any time.

4. Accounts

You must provide accurate registration information and keep your password secure. You are responsible for all activity under your account. We may suspend or close accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. Plans, pricing, and renewals

Lex offers three subscription tiers, billed monthly in advance:

• Basic — $4 / month. Vocabulary across all 34 languages, five exercise modes, curated starter words in 11 languages, CEFR tracking.
• Pro — $9 / month. Everything in Basic, plus essay writing with 70+ prompts, the reading section with a curated leveled library, one-tap word lookup while reading.
• Max — $19 / month. Everything in Pro, plus AI essay feedback (up to 20 per day), AI prompt generation (up to 30 per day), AI reading-text generation (up to 30 per day), and AI word translation while reading (up to 500 per day).

Subscriptions renew automatically at the end of each billing period unless you cancel before the next renewal. Prices may change with at least 30 days' notice for future billing periods. Payments are processed by Stripe. You can manage or cancel your subscription at any time from the billing portal linked in your account. Cancellation takes effect at the end of the current billing period.

6. AI features and usage limits

AI-powered features (essay feedback, text generation, prompt generation, word translation) are subject to per-feature daily caps listed on the Max tier above. These caps protect service availability and our costs; they are not a marketing maximum but a hard daily budget. We may adjust these caps with reasonable notice if usage patterns or upstream pricing change materially.

AI outputs are generated by third-party large language models (currently OpenAI). They may contain errors, omissions, or culturally inappropriate suggestions. You are responsible for reviewing and applying judgment before relying on AI output.

7. Right of withdrawal and refunds

If you are a consumer based in the EU, you generally have a 14-day right of withdrawal under § 312g BGB. By starting to use Lex during the free trial and then beginning a paid subscription, you receive immediate access to the digital subscription product. If you explicitly consent to this immediate access at checkout, you waive the 14-day right of withdrawal per § 356 Paragraph 5 BGB. Outside of the statutory withdrawal right, we do not offer refunds for partial billing periods, but you can cancel at any time to stop future charges.

8. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code
• Use AI features to generate content that is illegal, harassing, defamatory, sexually explicit involving minors, or that promotes violence or discrimination
• Use the service to send spam, malicious content, or to attack third-party systems
• Share, resell, or sublicense access to Lex without express written permission
• Interfere with other users' access or attempt to gain unauthorized access to any part of the service
• Attempt to circumvent the anonymous free-check rate limits (e.g. by automated scripts, VPN rotation, or browser fingerprint manipulation)

9. Intellectual property

Lex and its underlying code, curated content (starter word lists, reading texts, essay prompts), and brand assets remain the intellectual property of their creator. Content you create inside Lex — your own vocabulary entries, essays, pasted reading texts — remains your property; you grant us a limited license to store, process, and display it solely to provide the service to you.

10. Termination

You may terminate your subscription at any time via the billing portal or by deleting your account. We may suspend or terminate access for breach of these Terms, prolonged non-payment, or as required by law.

11. Disclaimer of warranties

Lex is provided “as is” without warranty of any kind beyond what is required by mandatory consumer protection law. We do not warrant uninterrupted, error-free, or perfectly secure operation, nor do we warrant the accuracy of CEFR level estimates or any other AI-generated output.

12. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or your use of Lex is limited to the amounts you paid in the 12 months preceding the claim. Liability for damage arising from injury to life, body, or health, or from intent or gross negligence, remains unaffected.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or via an in-product notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws provisions and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protections in your country of residence remain unaffected. The courts of Nuremberg shall have exclusive jurisdiction to the extent permitted by law.
